		<title>iPhone Developer Agreement Revealed By Electronic Frontier Foundation</title>

The Electronic Frontier Foundation (EFF) yesterday <a href='http://www.eff.org/deeplinks/2010/03/iPhone-developer-program-license-agreement-all' class='bbc_url' title='External link' rel='nofollow external'>announced</a> that it had obtained a copy of Apple's <a href='http://www.eff.org/files/20100302_iphone_dev_agr.pdf' class='bbc_url' title='External link' rel='nofollow external'>iPhone Developer Program License Agreement</a> and published it for public consumption.  While the contents of the license agreement, which governs the relationship between Apple and App Store developers, should obviously not be a surprise to the many developers already participating in the program, details of the contract have until now been kept relatively shielded from the general public due to nondisclosure agreements associated with the contracts.<br />
<br />
The EFF was able to work around this constraint by petitioning NASA, a U.S. government agency and developer of an <a href='http://appshopper.com/education/nasa-app-for-iPhone' class='bbc_url' title='External link' rel='nofollow external'>official NASA iPhone application</a>, under a Freedom of Information Act request.  NASA responded with a copy of the 28-page March 2009 version of the agreement.The terms of the agreement are not particularly different from those discussed in many places since the iPhone developer program was initiated, but it is interesting to view the actual text of the agreement, and the EFF points to a couple of interesting terms included in it.<br />
<br />
- Developers are prohibited from making any "public statements" about the terms of the developer agreement, which is obviously the driving factor that has kept the complete details out of publication for so long.<br />
<br />
- Developers using the iPhone SDK may only distribute their applications via Apple's App Store.  Use of any other competing App Store for the iPhone platform for distribution is forbidden, even if an application has been rejected from the App Store.<br />
<br />
- Reverse engineering of the iPhone OS or SDK is not permitted, and developers are not permitted to "disable, hack, or otherwise interfere" with security provisions on any Apple technology, such as jailbreaking their iPhones.<br />
<br />
- Apple's monetary liability to developers is limited to only $50.<br />
<br />
The EFF is a donor-funded non-profit organization focused on digital rights, and has been critical of Apple in the past over some of the company's actions.  The foundation has even gone so far as to offer legal defense to several sites <a href='http://www.macrumors.com/2006/05/26/apple-loses-in-asteroid-lawsuit-ruling/' class='bbc_url' title='External link' rel='nofollow external'>sued by Apple</a> over leaked product details.]]></description>

		<description><![CDATA[Apple today released iPhone SDK 3.2 Beta 4 via the <a href='http://developer.apple.com/iPhone/index.action' class='bbc_url' title='External link' rel='nofollow external'>iPhone Dev Center</a>, offering developers updated tools for building applications for the iPad.  The last update to the SDK was issued <a href='http://www.macrumors.com/2010/02/23/apple-releases-iPhone-sdk-3-2-beta-3-for-iPad/' class='bbc_url' title='External link' rel='nofollow external'>two weeks ago</a>, continuing a trend of biweekly revisions.<br />
<br />
There is no word yet on changes in the new version, but users with access to the SDK are undoubtedly already looking through the software to document the revisions.]]></description>

In the past we talked about the fact that Apple leaks itself, and also we showed you how and why they do that. But before Apple does that, we can benefit from all the mistakes committed by various mobile operators.<br />

In January, T-Mobile Germany messed up, revealing the iPad prices for Europe . Now, two months later, UK’s O2 updated their iPhone plans, adding prices for video calls. System files in the latest SDK shows that the next gen iPhone will do video calls, and O2’s mistake confirms that the next gen iPhone will feature a front camera.<br />

As you can see in the screenshot above ( you can also check O2’s official site ), the cockney iPhone users will be able to make video calls at the same price as voice calls.<br />

While Apple announced that the iPad would go on sale at the end of March, we've yet to hear official details about the actual sale date and procedure.    <br />

We have heard whispers the Apple is planning on launching the iPad at retail stores on Friday, March 26th at 6 p.m. in similar fashion to <a href='http://www.macrumors.com/2007/06/13/iPhone-on-june-29th-at-6pm-local-time/' class='bbc_url' title='External link' rel='nofollow external'>the original iPhone launch</a>.  <br />

A [url="http://www.examiner.com/examiner/x-11295-LA-Gadgets-Examiner%7Ey2010m3d2-iPad-Apple-store-employees-will-experience-device-on-March-10"]blog post</a> from the Examiner now makes similar claims of a March 26th launch date with Apple store employees getting training on the device starting on March 10th.   The author also claims that the commercials will start beginning on March 15th.  Finally, those who camp out for the iPad will receive a "special gift".  <br />

The 3G enabled version of the iPad will follow the Wi-Fi iPad launch by about 30 days, according to Apple.]]></description>

Apple today announced that it has filed suit against handset manufacturer HTC regarding alleged infringement of 20 iPhone-related patents. The patents cover such aspects as the user interface, architecture, and hardware.<br />

<a href='http://www.patentlyapple.com/patently-apple/2010/02/hot-off-the-press-apple-files-for-magic-trackpad-trademark.html' class='bbc_url' title='External link' rel='nofollow external'><em class='bbc'>Patently Apple</em> reports</a> that the U.S. Patent and Trademark Office (PTO) today published a trademark application filed earlier this week by Apple covering the term "Magic Trackpad".  The application requests registration in International Class 009 under a number of categories relating to computer hardware and software, as well as several types of peripheral devices.It is not entirely clear what technology the trademark is meant to apply to and whether it would be some aspect of existing trackpads using in Apple's notebook computers or if it would be some other device offering trackpad functionality.<br />

There has been speculation about some sort of multi-touch "trackpad gadget" since John Gruber <a href='http://www.macrumors.com/2009/10/19/rumors-of-new-apple-hardware-tomorrow-swirling/' class='bbc_url' title='External link' rel='nofollow external'>mentioned</a> such a possibility ahead of an October product launch from Apple that saw the introduction of every one of his claimed products except the trackpad gadget.  The speculation was further fed several months later with the <a href='http://www.macrumors.com/2009/12/25/apple-iSlate-trademark-and-what-is-a-magic-slate/' class='bbc_url' title='External link' rel='nofollow external'>revelation</a> that Apple had filed for a trademark on the term "Magic Slate".<br />

At the time, Apple had yet to introduce its much-rumored tablet device, and so speculation was consequently centered around that release.  But with Apple filing this new trademark application a month after the tablet device was introduced as the iPad, it appears that Apple may yet have something more up its sleeve.]]></description>

Apple is currently conducting its annual shareholders meeting on the company's campus in Cupertino, California, and while attendees were not permitted to bring communication devices into the meeting, <em class='bbc'>Fortune</em> is <a href='http://brainstormtech.blogs.fortune.cnn.com/2010/02/25/inside-apples-shareholders-meeting/' class='bbc_url' title='External link' rel='nofollow external'>gathering reports</a> from those in attendance who were able to get details out.  Apple CEO Steve Jobs is in attendance and reportedly answering the majority of questions from shareholders after missing last year's meeting due to health issues related to a liver transplant.<br />

In addition to expected agenda items such as re-election of members of Apple's Board of Directors and discussion of environmental and sustainability issues that have become a staple of Apple shareholder meetings, one brief item of interest coming out of the meeting is that Apple senior vice president of retail Ron Johnson noted that company is planning to open 25 retail stores in China.  The timeframe for the  store opening of these stores is currently unknown, although more details may be forthcoming.<br />

Apple opened its <a href='http://www.macrumors.com/2008/07/18/apple-opening-first-retail-store-in-china/' class='bbc_url' title='External link' rel='nofollow external'>first Chinese retail store</a> in Beijing in July 2008 ahead of the Olympic Games, and Johnson noted at the time that it was the "first of many" stores the company was planning to open there.  A year and half later, however, that location remains Apple's sole Chinese retail store.  Plans for a <a href='http://www.macrumors.com/2009/06/04/apple-retail-store-news-roundup/' class='bbc_url' title='External link' rel='nofollow external'>second store</a> in Beijing surfaced in mid-2009, but the project has been put on hold, although Apple Chief Operating Officer Tim Cook briefly noted during his <a href='http://www.macrumors.com/2010/02/23/apple-coo-tim-cook-speaks-at-goldman-sachs-conference/' class='bbc_url' title='External link' rel='nofollow external'>comments</a> at a Goldman Sachs conference earlier this week that a store will be opening in Shanghai by this summer.]]></description>

Most prominently, the document suggests the use of the proposed functionality to control voicemail options such as rewind, fast forward, pause and other options while the handset is held to the user's ear.  The patent application also describes integration of an accelerometer to detect tapping input to supplement the finger swipes.Apple's patent application also describes the use of swiping over the device's camera for navigation in a document or application.  Finger swiping over the camera lens could be used to navigate Web pages or other content such as contact lists.<br />

Apple has clearly been researching methods of input for its handheld devices that do not directly involve a touchscreen.  Several years ago, Apple filed a patent application describing the use of <a href='http://www.macrumors.com/2007/05/10/patent-multisided-and-touch-screen-iPod/' class='bbc_url' title='External link' rel='nofollow external'>"back side touch"</a> for controlling an iPod, while earlier this month the company was granted a patent for a <a href='http://www.macrumors.com/2010/02/03/apple-receives-patent-for-touch-sensitive-bezel-for-portable-devices/' class='bbc_url' title='External link' rel='nofollow external'>touch-sensitive bezel</a>.  One analyst has also <a href='http://www.macrumors.com/2010/01/13/next-generation-iPhone-to-offer-touch-sensitive-casing/' class='bbc_url' title='External link' rel='nofollow external'>claimed</a> that Apple's next-generation iPhone will include a touch-sensitive casing.]]></description>
